Vine/Instagram Contest Rules
The “NH Film Festival Vine/Instagram video #NHFF” Contest is intended for participation internationally and shall be construed according to, and governed exclusively by, United States law. You may not participate in the Sweepstakes if you do not fall within the eligibility requirements set forth in the Official Rules below.
NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
PROMOTION DESCRIPTION: The “NH Film Festival Vine/Instagram video #NHFF” Contest (the “Contest”) begins on or about August 15, 2014 at 12:00 am ET and ends on September 30, 2014 at 11:59:59 pm ET (the “Entry Period”). During the Entry Period, create at least one (1) wholly original “Vine” or “Instagram Video” and post via your authorized Twitter account with the hashtag “#NHFF” as more fully described below (each, a “Submission”). At the end of the Entry Period, a panel of judges will review all Submissions and select a pool of 10 semi-finalists from both Vine and Instagram submissions, as more fully set forth below. Each finalist will be contacted to verify their eligibility. After all eligible finalists have been identified, a panel of judges will select a winning Submission from each category (Vine and Instagram). During this time, the public may vote for an audience choice winner via the official NH Film Festival Facebook page. Entry in the Contest does not constitute entry into any other promotion, contest or sweepstakes. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of NH Film Festival, 155 Fleet St. Portsmouth, NH (“Sponsor”) and Sponsor’s designated independent judges, which shall be final and binding in all respects.
ELIGIBILITY: The sweepstakes are open to all participants who confirm they are 1) are eighteen (18) years of age or older, 2) have an authorized individual account with Twitter and Facebook. Sponsor reserves the right to verify eligibility qualifications of the semi-finalists and/or the winners. No group entries. This Contest is void where prohibited.
HOW TO ENTER:
To enter the Contest, visit www.nhfilmfestival.com/social-video-competition/, fill out the entry form and read the Official Rules. Entrants must like the official NH Film Festival Facebook page and follow @nhff on Twitter. Then use your enabled wireless device to access your authorized account associated with the Vine app (“Vine”) and/or Instagram app (“Instagram”) and follow the instructions to create a Vine and/or Instagram video (taking into account the Submission Requirements below). Next, post the Vine and/or Instagram video to your authorized account associated with the URL https://twitter.com with the hashtag #NHFF. Finally, follow (or make sure you are following) Sponsor’s branded Twitter account (@NHFF) from your authorized Twitter account. Upon posting the Vine and/or Instagram video to your Twitter account with the applicable hashtags and following NH Film Festival on Twitter, your Submission will automatically be entered.
Each Submission that is entered into the Contest must meet the following “Submission Requirements” (any Submission that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified):
(a) the Submission must not be longer than one (1) Vine video, six (6) seconds in duration for EACH vine submissions, or fifteen (15) seconds in duration for EACH Instagram video submissions.;
(b) the Submission must be the submitting entrant’s original work and not contain any third party copyrighted material, nor any obscene, defamatory or illegal material; and
(c) the entrant should be able to provide on request all appropriate clearances, permissions and releases for the Submission, including releases from all persons referenced to, described in, appearing in the Submission (in the event an entrant cannot provide all required releases, Sponsor reserves the right, in Sponsor’s sole discretion, to disqualify the applicable Submission, or seek to secure the releases and clearances for Sponsor’s benefit, or allow the applicable Submission to remain in Contest).
Any Submission must be made by the entrant, and only in accordance with the instructions above. Tampering with the entry process or the operation of the Contest, including but not limited to the use of any device to automate the entry process, is prohibited and any entries deemed by Sponsor in its sole discretion, to have been submitted in this manner, will be void. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Sponsor shall not be responsible for incorrect or inaccurate entry information whether caused entrant or by any technical or human error that may occur in the processing of the Submissions. Sponsor assumes no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of Submissions.
WINNER SELECTION AND NOTIFICATION: At the end of the Entry Period, Sponsor will judge all eligible Submissions entered to select up to ten (10) finalists (5 in each category). Sponsor will judge the Submissions based on the following criteria: creativity, originality, style and capturing the potential of mobile generated content. No later than October 5, 2014, Sponsor will contact the finalists via their respective authorized Twitter accounts to confirm their eligibility and secure signed releases from them with respect to their Submissions. Beginning on or about October 5, 2014, Sponsor may display all verified finalist Submissions on its Website for public viewing. Sponsor will assemble a judging panel to select one (1) winner for best Vine and one (1) winner for best Instagram video. The judging panel will judge the finalists using the same criteria as above. During this time, voting for an “audience choice award” will be conducted via the NH Film Festival Facebook page. Voting will close on October 12th at 11:59:59 pm ET. On or about October 13, 2014, Sponsor will notify the three (3) winners by telephone, e-mail, and/or mail using the contact information provided at the time of verification. In addition, if Sponsor elects, the announcement will also be posted online at the Website. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. Time is of the essence in verifying each winner and awarding each prize. If, despite reasonable efforts, a potential winner does not respond within twenty-four (24) hours of the first notification attempt, or if the prize notification is returned as undeliverable to such potential winner, such potential winner will forfeit his or her prize and a runner-up winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Sponsor may successively attempt to contact up to two (2) potential winner(s) of an applicable prize in accordance with such procedure, and if there is still no confirmed winner(s) of such applicable prize after such attempts have been made, if any, such prize may go unawarded.
PUBLICITY RELEASE: By participating in the Contest, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant in and/or winner of the Contest, each entrant irrevocably grants to Sponsor and the Promotion Entities and their respective successors, assigns and licensees, the right to use such entrant’s name, photograph, likeness, voice, biographical information, and any other personal characteristics, in addition to the entrant’s statements, and address (city and state) in any and all media now known or hereafter developed for any purpose, in perpetuity, including without limitation, advertising and promotional purposes as well as in, on or in connection with the New Hampshire Film Festival and any programs thereof, the Website or the Contest, and each entrant and/or prize winner hereby release Sponsor and the Promotion Entities from any liability with respect thereto.
REPRESENTATIONS AND WARRANTIES / INDEMNIFICATION: Each person who enters this Contest represents and warrants as follows: (i) the Submission is the entrant’s own original, and previously unproduced work; (ii) the Submission is wholly original with entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) the Submission does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; and (iv) the Submission does not and will not violate any applicable laws, and is not and will not be defamatory or libelous. Each entrant hereby agrees to indemnify and hold the Promotion Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.
PRIZES/ODDS: There are three (3) Prizes available. Each Prize consists of two (2) VIP passes to the film festival. The Prize/s may be picked up at NH Film Festival headquarters: The Discover Portsmouth Center (10 Middle St. Portsmouth, NH 03801) during open hours at the film festival.
GENERAL PRIZE CONDITIONS: Each prize will be awarded only if the applicable potential prize winner fully complies with these Official Rules. Each prize winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize.
Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Contest.
GENERAL LIABILITY RELEASE/FORCE MAJEURE: Acceptance of a prize constitutes winner’s permission for the Promotion Entities to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Entrants agree that Promotion Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Contest or any Contest-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s, or any other person’s, computer system which is occasioned by participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsman/unsportswoman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. If a dispute as to the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Sponsor reserves the right to modify, extend, suspend, or terminate the Contest if it determines, in its sole discretion, that the Contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Contest as contemplated herein. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from conducting the drawing, awarding prizes or continuing with the Contest as contemplated herein by any event beyond its reasonable control, including but not limited to fire, storm, flood, earthquake, explosion, accidents, public disorders, civil unrest, disease outbreak, sabotage, acts of terrorism, acts of war (declared or undeclared), labor shortages riots or acts of God or public enemy, satellite or equipment failure, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) select the winner from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Only the type and quantity of prizes described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF NEW HAMPSHIRE WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
NO INJUNCTIVE RELIEF: Each entrant understands and agrees that the entrant shall have no right to enjoin or restrain the development, production, advertising, promotion, distribution or exploitation of the Contest or the New Hampshire Film Festival, or any other business or project of Sponsor or any of the Promotion Entities.
If any part of these Official Rules is deemed to be invalid or otherwise unenforceable or illegal, the balance of these Official Rules shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision, or the invalid or illegal portion of a provision, were not contained herein.
WINNER’S LIST/OFFICIAL RULES: These Official Rules and the winner’s list will be posted on the Website during the Entry Period and for at least six (6) weeks thereafter.
